Might need to be weighted as well...

A non-spell caster with a +spell damage gem should prob have 0 pts, while a spell caster should have something added...

That one is tricky also. For example, some people have around 20+ sockets in their gear. Some barely have few. It's no one's fault, both items are nice (with or without sockets). It might be a good idea to measure the overall quality of gems tho, not the amount of gems, and give small bonuses according to that. It's definitely worth to think about.

Even if 2 playes have the exact same gear set... Let's say 20 sockets for the set...

If one has sockets filled and the other doesn't... well, no way could I consider them equal in value... 20 socketed gems... that makes a difference... even fewer...

A way to do this may be to subtract from the item score for unsoceted items, for example:

Unsoceted: -2
Uncommon Level Gem: -1
Rare Level Gem: 0
Epic Level Gem: +1

As well as a weight scale, This gives you 4 points to play with for weighted items. It also rewards those who invest into their gear. However some items can gain +3 item level< but with epic gems it does make the gear a bit better, thus increasing it's comparative level.
